Terms of Service for Splitting Axe

These Terms of Service (“Terms”) govern your access to and use of the Splitting Axe website, mobile/web application, and related services (collectively, the “Services”), provided by Splitting Axe (“Splitting Axe,” “we,” “us,” or “our”).

By accessing or using the Services, you agree to these Terms. If you do not agree, do not use the Services.

1. Eligibility and Account Registration

You must be at least 13 years old (or the minimum legal age required in your jurisdiction) to use the Services.

If you create an account, you agree to:

  • Provide accurate and current information;
  • Keep your credentials secure;
  • Be responsible for all activity under your account; and
  • Notify us promptly of unauthorized access.

We may suspend, restrict, or terminate accounts consistent with these Terms.

2. Acceptable Use and Prohibited Conduct

You may not use the Services to engage in unlawful, harmful, or abusive conduct. Prohibited conduct includes, without limitation:

  • Violating any law, regulation, or court order;
  • Infringing intellectual property, privacy, publicity, or other legal rights;
  • Uploading malware, malicious code, or attempting unauthorized access;
  • Interfering with the integrity, security, or availability of the Services;
  • Impersonation, fraud, or deceptive practices;
  • Doxxing, stalking, targeted harassment, or credible threats of violence;
  • Incitement of violence or criminal activity;
  • Content that is unlawful hate speech under applicable law;
  • Defamatory statements presented as fact about an identifiable person;
  • Automated scraping/bot activity that imposes unreasonable load or bypasses protections.

You are solely responsible for your conduct and submitted content.

3. User Content and License

“User Content” means content you submit to the Services (for example, text, notes, comments, uploads, prompts, or form data).

You retain ownership of your User Content.
You grant Splitting Axe a non-exclusive, worldwide, royalty-free license to host, store, reproduce, process, modify (for technical and formatting purposes), and display User Content solely to operate, secure, maintain, and improve the Services.

You represent and warrant that:

  • You have the rights needed to submit the User Content; and
  • Your User Content does not violate law or these Terms.

4. Content Moderation and Enforcement

We may (but are not required to) monitor content and behavior for compliance with these Terms and applicable law.

We reserve the right, at our sole discretion, to:

  • Remove, restrict, or refuse content;
  • Issue warnings;
  • Suspend or terminate accounts; and
  • Report conduct to law enforcement where appropriate.

Enforcement may occur with or without prior notice where needed for legal compliance, safety, security, or platform integrity.

We may preserve and disclose information where reasonably necessary to investigate violations, enforce these Terms, protect rights/safety, or comply with legal obligations.

5. Reporting Abuse and Legal Complaints

If you believe content or conduct violates these Terms or law, contact us at legal@splittingaxe.org with:

  • Your contact information;
  • A description of the issue;
  • Relevant URLs/screenshots/identifiers; and
  • Why you believe it violates policy or law.

We review reports in good faith and may request additional information.
Submitting knowingly false reports is prohibited.

6. Third-Party Services and Integrations

The Services may integrate with third-party providers (e.g., authentication providers such as Google, payment processors, hosting, analytics, and communications tools). Those third-party services are governed by their own terms and policies.

We are not responsible for third-party services, availability, security practices, or decisions.

7. Donations and Payments

Certain payment or donation functions may be available through our giving partner, Tithe.ly, and/or other third-party processors.

By making a payment or donation, you agree that:

  • You are authorized to use the payment method;
  • Processing, disputes, chargebacks, and failures may be governed by processor terms;
  • We may suspend features pending chargeback/fraud review.

Unless expressly stated otherwise in a posted policy, donations are voluntary and generally non-refundable to the extent permitted by law.

8. Intellectual Property Rights

The Services (excluding User Content), including software, structure, design, text, graphics, logos, and trademarks, are owned by or licensed to Splitting Axe and protected by law.

Except where expressly permitted, you may not copy, modify, distribute, sell, lease, reverse engineer, or create derivative works from the Services.

9. Privacy

Your use of the Services is also governed by our Privacy Policy, which describes how information is collected, used, and disclosed.

10. Service Changes, Availability, and Beta Features

We may modify, suspend, or discontinue all or any part of the Services at any time.

The Services may include experimental or beta features. These may be changed or removed at any time and may be less reliable.

We do not guarantee uninterrupted, secure, or error-free operation.

11. Disclaimers

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.

We do not warrant that:

  • The Services will meet your requirements;
  • The Services will be uninterrupted, timely, secure, or error-free;
  • Any content will be accurate, complete, or reliable for every purpose.

Use of the Services is at your own risk.

12. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, SPLITTING AXE AND ITS OFFICERS, DIRECTORS, OWNERS, EMPLOYEES, CONTRACTORS, AFFILIATES, AND AGENTS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR LOSS OF PROFITS, REVENUE, DATA, GOODWILL, OR BUSINESS OPPORTUNITY.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUR AGGREGATE LIABILITY FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THE SERVICES WILL NOT EXCEED THE GREATER OF:

  1. THE AMOUNT YOU PAID US IN THE 12 MONTHS BEFORE THE CLAIM; OR
  2. USD $100.

Nothing in these Terms limits liability that cannot be limited under applicable law.

13. Indemnification

You agree to indemnify, defend, and hold harmless Splitting Axe and its officers, directors, owners, employees, contractors, affiliates, and agents from and against any claims, liabilities, damages, losses, costs, and expenses (including reasonable attorneys’ fees) arising out of or related to:

  • Your use of the Services;
  • Your User Content;
  • Your violation of these Terms; or
  • Your violation of applicable law or third-party rights.

14. Suspension and Termination

We may suspend or terminate your access immediately, with or without notice, if:

  • You violate these Terms;
  • We reasonably suspect fraud, abuse, or unlawful conduct; or
  • Suspension is needed for legal, safety, or security reasons.

Upon termination, your right to use the Services ceases immediately.
Sections that should survive termination (including ownership, disclaimers, limitations, indemnity, dispute terms) will survive.

15. Governing Law and Venue

These Terms are governed by the laws of the State of Ohio, without regard to conflict-of-law principles.

Unless otherwise required by law, exclusive jurisdiction and venue for disputes will be in state or federal courts located in Ohio, and you consent to personal jurisdiction there.

16. Changes to These Terms

We may revise these Terms from time to time. Updated Terms become effective when posted (or on a stated effective date). Continued use of the Services after that date means you accept the revised Terms.

17. Severability and Entire Agreement

If any provision of these Terms is held unenforceable, the remaining provisions remain in full force and effect.

These Terms, together with any incorporated policies (including the Privacy Policy), constitute the entire agreement between you and Splitting Axe regarding the Services.
